SITE PLAN REVIEW COMMITTEE
March 21, 2007 - Minutes

A meeting of the Site Plan Review Committee was called to order at 10:00 a.m. in Skaket Meeting Room at the Orleans Town Hall.  Departments Present:  Mark Budnick  (Highway); Bob Canning (Health); Bill Quinn (Fire); Brian Harrison  (Building); Todd Bunzick (Water); George Meservey (Planning). Absent:  Jennifer Wood (Conservation).   


INFORMAL REVIEW:  J. Bruce MacGregor, 15 Giddiah Hill Road

Bill Quinn made a disclosure that he has been a customer of J. Bruce MacGregor and offered to recuse himself from this discussion and nobody indicated any issue with this disclosure.     

Stephen Hayes (Architect) and J. Bruce MacGregor were present for this application and indicated the intent  to construct a new mini storage warehouse at 15 Giddiah Hill Road.  Hayes stated that this project was originally submitted and approved for a 2,524 square foot building by the Site Plan Review Committee in 1999, but the work never commenced.  The new proposal includes an increase of the building by 270 square feet for a resulting square footage of 2,794.  Stephanie Sequin (Ryder & Wilcox) has reviewed and submitted drainage calculations in the revised Site Plan.  

Comments:       

Fire:   There is adequate access for emergency vehicles.  The lease agreements must include a stipulation that no hazardous materials are allowed.  
Health: An engineer will have to submit a letter stating that there is no relationship between the buildings served the septic system.   If there is an increase in flow, a Engineer’s letter must be submitted indicating that the septic system is adequate for the increase in flow.  The septic system must be inspected.  No floor drains are allowed.  The location of the dumpster must be shown on the plan.  
Water:          Water supply to the building must be shown on the plan.  
Building:       The same comments apply from the Site Plan in 1999.  All exterior lighting must conform to the Orleans Lighting bylaw (shielded and pointed downward) and manufacturer tear sheets must be provided for town review and must be shown on the plan.
Planning:       Trees must be preserved on the abutting property line, particularly the oak trees near the lot line.  

MOTION:  On a motion by Brian Harrison, seconded by Bill Quinn, the Committee voted to accept the Informal Site Plan prepared for J. Bruce MacGregor for property located at 15 Giddiah Hill Road, dated April 14, 1999, revised May 20, 1999, revised March 13, 2007 (Building Dimensions) by Ryder & Wilcox as the Formal Site Plan of record.  

VOTE:   5-0-0      The motion passed unanimously.  


Mark Budnick arrived at the Site Plan Review Committee meeting.


INFORMAL REVIEW:  The Corner Store (Chuck Konner & Steve DeLeonardis), 130 Route 6A (Orleans Marketplace)

The following people were present for the presentation of the proposal for The Corner Store:  Chuck Konner & Steve DeLeonardis (applicants), and Todd Thayer (Cape Cod Management).  Meservey state that this proposal is for a change of use in the commercial center of town from a retail furniture store to a 2,470 square foot restaurant space.    The applicants noted that they presently run a similar business in Chatham and are looking for a location in Orleans.  There will be limited seating and all new equipment will be provided.  

Comments:       

Fire:   The sprinkler heads will have to be adjusted and a permit will have to be obtained.  A permit will be required for the hood system and must be installed to the UL 300 standard with regard to the type of extinguishing agent.  Most of the time there is adequate access for emergency vehicles, but the clutter in the rear will have to be cleaned up and contained.  
Health: The septic system falls under the Department of Environmental Protection control and will need their approval for the Change of Use and increase in flow from retail to restaurant use.    Interior floor plans and specifications must be submitted as soon as possible to the Health Department for their review.  Must meet approval standards for all food codes.  Caution must be maintained regarding setbacks.  1,000 minimum gallon system is required for a restaurant and connecting to the old LoCiceros restaurant system may be preferable to connecting to any other existing septic system on site.  Any old grease traps must be removed.  This proposal will fall under State review.  The final position of the walk-in coolers must be approved and shown on the final Site Plan.  
Water:  An updated Utility Plan will need to be submitted outlining all of the utilities on site, especially the ones in the rear of this building.  The sprinkler line into the building must be shown on the final Site Plan.  
Building:       This project will fall under controlled construction.  Fast food is not allowed anywhere in town, but conventional restaurants are allowed in town
Highway:        No Highway Department issues.  
Planning:       The rear of the business block is unkempt and must be cleaned up and better emergency vehicle access must be provided.  Parking on the site is adequate for this business proposal.  

There was a consensus of the Site Plan Review Committee that this application will have to come back for a Formal Site Plan Review.  


FORMAL REVIEW:  Cuffy’s (Dominic Albano), 14 & 16 Route 28

The following people were present for the presentation of the proposal for Cuffy’s:  Dominic Albano (applicant), Richard Fenuccio (Brown Lindquist Fenuccio & Raber Architects, Inc.), and Mark Dibb (BSC Group).  Fenuccio provided the Site Plan Review Committee with a memorandum dated march 20, 2007 and verbally answered the list of the requirements from the Informal Site Plan Review meeting on September 6, 2006.  The committee discussed each item with Fenuccio in order to determine whether the various outstanding issues have been adequately addressed.  


Comments:       
Fire:   There is adequate emergency vehicle access on site.  Since this will ultimately become one continuous building, the applicant and the Site Plan Review Committee agreed that the address for this building will now be known only as
# 14 Route 28 in all of the town’s records.  
Health: No food preparation will be allowed on this site.  Additional soil testing is required for this site and the reserve area must be shown on the Site Plan.  All adequate separations must be maintained from the septic system.  All calculations must include basement and storage areas.  A letter from an Engineer must be provided to the Health Department stating that the location of the septic under the driveway is unavoidable.  
Water:  All utilities must be shown on the Site Plan and it must be clearly shown that there are not conflicts with the water line.  It may be prudent to sleeve the water line to avoid having to dig it up in the future.  A flow test must be performed.  The fire line must be approved by the Fire Department, Building Department and the Water Department regarding sprinklers.  
Highway:        The plan addresses the traffic flow and drainage.  
Building:       Building height discrepancies must be dealt with through the Building Department.  All signs must conform to the Orleans Sign Code specifications.  
Planning:       A Landscaping Plan must be provided and approved as part of the final Site Plan.  A paved apron must be shown to the dumpster.          

There was a consensus of the Site Plan Review Committee that this application will have to come back for a continuation of the Formal Site Plan Review.  


FORMAL REVIEW:  von Thaden Builders (William Reyburn), 19 Cove Road

Bob Canning made a disclosure that he has been a customer of William Reyburn and offered to recuse himself from this discussion and nobody indicated any issue with this disclosure.     

William Reyburn (applicant) and David Lyttle (Ryder & Wilcox) were present for this application for an addition to the building at 19 Cove Road.  A building has been moved from another site on Monument Road and will be reconstructed at this site.  The proposal will provide additional office space, but there will be no increase in the residential component of this building.  The existing parking will remain the same.  Fire separation will be provided between the second floor residential development and the office space.  The application will be considered at the Architectural Review Committee on March 22, 2007.  

Lyttle reported that the septic system is adequate for the increased flow for this site and the reserve area is shown on the Site Plan as required by the Health Department.  Nine parking spaces are being provided for this site which is more than required by the bylaws, although it is admittedly a tight fit.  There will only be a maximum of four employees on site.  

Comments:       

Fire:   There is adequate access for emergency vehicles, although it is admittedly a tight area.  No sprinkler system is required.     
Health: There are no Health Department issues.  
Water:          There are no Water Department issues.  
Highway:        The parking area is very tight.
Building:       The addition must be brought up to code and the second floor office space must be clearly marked.  All public bathrooms must be handicapped accessible

MOTION:  On a motion by Bill Quinn, seconded by Bob Canning, the Committee voted to approve the Site Plan for Von Thaden Builders, dated March 2, 2007 for property located at 19 Cove Road.

VOTE:  6-0-0    The motion passed unanimously.


APPROVAL OF MINUTES:  March 7, 2007

MOTION: On a motion by Bob Canning, seconded by Brian Harrison, the Committee voted to approve the minutes of  March 7, 2007.  

VOTE:  4-0-2    The motion passed by a majority.  (Bill Quinn and Todd Bunzick abstained)
